CFTC Chairman Says US Is Ready for New Crypto Regulations

CFTC Chairman Michael S. Selig declared the agency “locked in and ready to ship its rules for the new frontier of finance” on September 16, 2026, one day after the Senate voted to block the Digital Asset Market CLARITY Act, signaling that US crypto oversight will move forward through agency rulemaking rather than legislation.

Senate Rejection Triggers CFTC Fallback Plan

The Senate voted 49-50 on September 15 against advancing the CLARITY Act; the bill required 60 votes to move forward. For related coverage, see SEC Chair Paul Atkins Says Agency Is Building Crypto Framework for Certainty.

Selig had laid out this contingency in an August 20 Innovation Advisory Committee address, saying the CFTC would use its existing statutory authorities to begin establishing a regime for crypto-asset markets if CLARITY stalled. He directed staff to explore rules allowing registrants and non-registrant crypto exchanges to be designated as “crypto asset markets” and offer leveraged or margined crypto-asset trading under purpose-fit CFTC oversight. The fallback is an administrative pathway, not a legislative one. This distinction matters: agency rules can be revised or reversed by a future administration, whereas a statute would establish more durable jurisdictional lines and core principles. The current industry response, as covered in post-vote reporting, centers on that caveat. For related coverage, see CFTC: stablecoin underneath its jurisdiction but lacks Congressional course.

CFTC and SEC Already Moving in Tandem

The CFTC and SEC are not starting from zero. On March 17, 2026, the two agencies jointly issued interpretive guidance on crypto-asset treatment, with the SEC component introducing a taxonomy covering digital commodities, digital collectibles, digital tools, stablecoins, and digital securities. That coordinated release, part of what the CFTC has called Project Crypto, established a shared classification framework ahead of any formal rulemaking.

SEC Chair Paul Atkins has separately pursued a parallel agenda; Atkins said the SEC is building a crypto framework for certainty, and he previously expressed confidence that Congress would pass a market structure bill. The Senate’s 49-50 vote complicates that timeline.

What to Watch

Bitcoin was trading at $76,131, up 0.22% over 24 hours, as the regulatory developments unfolded.

The immediate items to monitor: whether the CFTC publishes a formal notice of proposed rulemaking for the “crypto asset market” designation, any SEC follow-through on its digital asset taxonomy, and whether Senate sponsors attempt another CLARITY Act vote. The CFTC’s own roadmap framed legislation as the preferred outcome; rulemaking is the fallback. Any renewed legislative push would likely slow or redirect the agency’s administrative timeline.

The CFTC’s earlier position on specific asset classifications, including its view that stablecoins and Ethereum are not securities, will factor into how the new “crypto asset market” designation is scoped, particularly for leveraged and margined products.
